Terms of Service
1. Acceptance
By creating a NiteDate account, joining a speed-date session, or using any feature of the NiteDate mobile app or website (collectively, the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use NiteDate. We may verify age and identity at any time. By using the Service you represent that the information you provide (including your date of birth, location, and any photos or videos) is accurate.
3. Membership tiers and payments
NiteDate offers three paid membership tiers (Walk-on, Featured, and Lead). On the web, payments are processed by our card processor (Stripe); in the mobile apps, purchases are processed through Apple In-App Purchase or Google Play Billing per the platform's standard terms. Subscriptions auto-renew until cancelled, and you can cancel anytime. App-store purchases are governed by the relevant app store's refund policy; for web purchases, refunds where offered follow our posted billing terms.
4. Shows are recorded
Every NiteDate speed-date session is video- and audio-recorded for the purpose of producing an edited episode (long-form on YouTube and short clips on TikTok / Instagram Reels) hosted on accounts owned by NiteDate. By joining a session, you grant NiteDate a worldwide, perpetual, royalty-free license to record, edit, store, distribute, and promote the resulting content. Lead-tier members may opt out of recording before a session starts; opt-outs cannot be applied retroactively. See the Privacy Policy for details on how recordings are stored and accessed.
5. Conduct
You agree not to use the Service for harassment, hate speech, spam, fraud, impersonation, posting sexually explicit material, violating others' intellectual property rights, or any activity that violates applicable law. Our AI co-host (Cass) reviews each session and may flag content for human review; violations may result in immediate suspension, removal of your content, and forfeiture of paid membership.
6. User-generated content
You retain ownership of your profile photos, profile videos, and any other content you upload. You grant NiteDate a worldwide, non-exclusive, royalty-free license to use, store, display, and process that content as necessary to operate the Service (including matching, casting, and publishing edited episodes).
7. Termination
You may delete your NiteDate account at any time from Settings → Account → Delete account. We may suspend or terminate accounts that violate these Terms or applicable law. On termination, your profile, photos, and videos are deleted from active systems within 30 days; recorded shows you previously participated in may remain published as part of the produced episode.
8. Disclaimers
The Service is provided "as is" without warranties of any kind. NiteDate does not guarantee that any particular match, connection, or relationship will result from using the Service. We do not screen members beyond automated age and identity checks; meeting other members in person is at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, NiteDate's total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.
10. Changes
We may update these Terms from time to time. Material changes will be announced via in-app notification or email at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.
